Trial date set for Hyrum woman charged with allegedly breaking into family relative’s home

LOGAN — The case for a 41-year-old Hyrum woman accused of burglarizing a family member’s home and stealing around $30,000 is set for a jury trial. Amanda Lescoe has been out of jail on bail since being arrested May 26, 2021.

Lescoe participated in a pretrial conference in 1st District Court Monday morning. She was previously charged with four counts of burglary of a dwelling and one count of theft, all second-degree felonies.

Judge Spencer Walsh expressed a desire to move the case forward, noting that the charges were filed over a year ago. He said he was hopeful that attorneys were trying to resolve the case.

According to an arrest report, the Cache County Sheriff’s Office received a complaint of the burglary from the alleged victim in March 2020. The woman claimed Lescoe would enter her Nibley home while she was gone and take large sums of money from a safe.

The alleged victim told investigators, the safe had approximately $40,000. She later noticed that nearly all of the money was gone, with the exception of approximately $4,000.

The woman described how when she confronted Lescoe about the theft. The suspect allegedly admitted to entering the home 4-6 times for the purpose of taking money from the safe.

Investigators later questioned Lescoe. She claimed that she was coerced by her family to admit to the thefts. However, she would not specify what manner they had pressured her, according to the report.

During Monday’s hearing, defense attorney Wayne Caldwell said he and prosecutors have continued to work on a possible plea deal but there were discrepancies about the restitution amount.

Judge Walsh also acknowledged that the case has been postponed due to prior coronavirus restrictions on court proceedings. He scheduled the two day jury trial to begin February 15, 2023.

According to court records, Lescoe was convicted of similar charges in February 2019. She later accepted a plea deal, pleading guilty to an amended charge of burglary. She was sentenced to serve 10-days in jail and three-years probation.

Lescoe was ordered to appear again in court September 19. She could face up to 15 years in prison, if convicted.

Individuals arrested and charged in complaints are presumed innocent unless or until proven guilty beyond a reasonable doubt in court.
