Jared Martindale sentenced after confessing to molesting girls 31 years ago

LOGAN — After 31 years, Jared Martindale was sentenced for molesting two young girls when he was a teenager. Judge Brian Cannell expressed disgust with the 45-year-old Logan man and said what he did was horrific and had lasting impacts.

Martindale was sentenced in 1st District Court Tuesday morning. He previously accepted a plea deal, pleading guilty to sexual battery and attempted sexual battery. As part of the deal, attorneys agreed to lower the charges from felonies to misdemeanors because they were committed when the defendant was a juvenile.

According to the indictment, the crimes took place in 1988, when Martindale would have been around 15-years-old. The alleged victims were acquaintances, both under the age of 13.

Previously, Martindale’s defense attorney Wayne Caldwell questioned how the case was being tried in adult court, when the crimes occurred when Martindale was a juvenile. He said if the case was filed in 1988, it would have resulted in a possible sentence of therapy and counseling, instead of prison and a life time on the sex-offender registry.

During Tuesday’s sentencing, one of the women Martindale abused, talked about the nightmares she had carried for 31 years. She explained how the defendant molested her repeatedly when she was around 8-years-old. He would also rape her, while taking showers with her.

Speaking to Martindale, the victim tearfully described how the abuse had left more than just physical damage. She explained how she battled feelings of unworthiness, and still felt violated as the memories of the abuse was relived.

The victim called Martindale a predator and child molester. She said, “Today, I’m stepping out of hell and letting you take my place.”

Cache County Deputy Attorney Dane Murray praised the victim for her courage and said he understood the difficulty of the case since it occurred in 1988. He asked the court to order the defendant to pay for the victim’s counseling and complete sex-offender therapy.

Martindale told the court he hoped everyone could move on. He said he was sorry for his actions, but refused to answer whether the victim was telling the truth.

Judge Cannell said he believed the victim. He told Martindale that he hadn’t owned up to what he did, explaining that stealing someone’s virtue was one of the worst crimes that could be committed. He ordered the defendant to serve 160 days in prison, and gave him credit for the time already served, since the charges were filed.

In April 2017, Martindale was sentenced to prison for threatening his ex-wife. The woman claimed that during their 20-years of marriage, he had abused her physically and emotionally. She described how he had threatened to kill her, cut her into little pieces and put her in a suitcase, so no one would find her.

Two years later, Martindale was placed back in prison for violating his parole, when the sexual abuse case was filed. The state parole board will now determine when he is released.

    Every person over the age of 18 better look over your shoulder and hope that you didn’t do anything wrong as a juvenile. Allowing and trying this case in an adult court is unconstitutional. It could happen to anyone to you and this court case sets a precedents going forward that juvenile cases can be tried in an adult court and can get adult punishments 30 -40 years later. I have talked to 100’s of people and there are very few that are innocent. Mr. Martindale is a victim too. This would have never gone the way it did had Mr. Martindale not been an adult, standing in an adult court. It is just to bad that he couldn’t bring out the also victimized 13-14 year old boy to be tried the way a 13-14 year old victimized boy would be. I am not saying that the victim is to blame. I am saying that the way this was carried out is truly unconstitutional and with the “me to” movement” watch out world.

      Here’s an idea: don’t be a child molester, wife abuser, rapist a-hole. That’ll keep you out of court/prison. Own your behavior. Millions of men do and are just fine. Sounds like you have a guilty conscience.

      Are you kidding me!!?? Martindale a victim????? He has been a POS rapist abuser his entire life!! So what if it took 30 years for him to start paying for that!!? He’s had enough time on the outside to way too much damage to women & teenage boys!! He should be locked up forever!! May he gets what he deserves in Prison!! Rot in Hell you POS!!?

      J Allsop, you say you have talked to 100’s of people and “there are very few that are innocent” – of raping a child when they were 15 years old? Really? I find that really hard to believe that you know so many people who were sex offenders starting as teenagers! Perhaps many people did things they aren’t proud of as teens but probably very few raped little girls. You’re not saying the victim is to blame? It sounds like both of your posts are victim-blaming at it’s best! Remember…. SHE WAS EIGHT YEARS OLD!!! The OTHER victim was also under 13 years old. Don’t forget, there are at least two little girls Martindale was raping!. You say there is more to the story and you aren’t bringing that out. Wow – there really isn’t much more to the story than Martindale raped an eight year old little girl and another girl under 13 when he was a teenager in high school. And based on how this has affected the victims’ lives for the past number of years, they have every right to come forward. Based on Martindale’s criminal past with even a stint in prison, it’s clear that there is much more to his story.

      I agree with you that his children, like many other criminals’ children, are innocent. So not only do Martindale’s actions over decades hurt victims, they also hurt his children; but again, that would be Martindale’s fault, not his victims.

    Please remember that there are several similar cases going on and the courts are looking for guideline. Judge Cannel DID NOT try him as a adult.
    His case will be under jurisdiction of Board of Pardons and Parole for sentencing. He is on prison now for spouse abuse/violating protective order/violating parole with DUI and assault of officer.
    Remember, too. A tiny 8 year old girl and a 15 year old big football linebacker.

    “ I don’t know what my life would of been like if Jared never did this…. but what I can tell you, what my life has been like because of it…. sad, hiding, anxiety filled, serve depression, doubting, angry, second guessing, no close friendship, hating my body, attempting suicide, ups and downs, pretending I’m ok, hiding behind masks so no one sees my pain, crying myself asleep some nights because I feel worthless, hating my mom because Jared said she wouldn’t believe, missing out on a relationship with my siblings…, in short, HELL. I don’t know about you, but I’d much rather live in my “what if’s,” then spend another day in HELL… where people like myself, don’t belong… it’s predators and abusers like Jared that should be living daily in HELL…. however, it’s not that way… I wasn’t given a choice, Jared put me there as soon as he decided to violate my 8 year old body… and today, I am stepping out of the hell he put me in, and giving up my space in hell for him to occupy now……Just remember- I was in elementary school while Jared, you were in high school.”

    I am sorry that the comments made to my comments are so confused and misinformed. Not in High School. Get it right. It’s a mighty thin pancake that doesn’t have two sides. We have been very careful not to tell the other side as to not hurt the victim more. There are some things that will not be made public about the victims life and family. Not by Jared or his family. But none the less the truth is the truth. There is another side. There are facts that could be made known. It doesn’t make it right for any of those to be made public. JJared admits and is wrong for what his part was and is paying the price. Is that not enough for you? Jared was a tried for a juvenile crime in an adult court. It is not constitutional. Even the judge knows this. This news writer should be so ashamed. Does he really think he is writing the truth and does he really think it is okay as do all of you think it is okay to continue to victimize jared’s innocent children by this kind of reporting. And the victim needs to stay the hell away from Jared’s family. Go to a different place to get your drinks and stay out of their line and the children’s games. Does being so mean help? Just wondering? I don’t think so. He who is without sin let him cast the first stone. Continue to look over your shoulder people it is coming your way.

    Ja, your comment is downright scary. This wasn’t a sin, it was pure evil. For those who hurt children it would have been better to be drowned with a millstone around their neck. That is how God feels about His little ones. Maybe the victim drinks, you would too if you were repeatedly rapes when you were just 8 years old. He is the perpetrator and there is no excuse for it. He abused his wife as well. He should stay in jail hoping he can’t hurt anybody else anymore but that’s hopeful thinking. Real filth right there.
