Possible plea deal coming for Nibley man accused of sexting teenage girl

LOGAN — Attorneys are working out a possible plea deal for Nicholas L. Smith. The 32-year-old Nibley man is charged with allegedly sexting a teenage girl, filming himself having sex with people, and distributing the videos on the internet.

Smith appeared in 1st District Court Tuesday morning. His defense attorney said, he and the prosecutor had been discussing a possible resolution. He asked the court for more time to negotiate the settlement.

The plea deal would allow Smith to plead guilty to lesser charges. It would also bypass a trial, where the victims would be called to testify.

Smith was originally arrested in December after a family member called deputies. They reported finding “disturbing text messages” on his phone.

Deputies believe Smith recorded himself having sex with people multiple times in Nibley and also Logan Canyon. The victims claimed they did not know they were being filmed. Some of the videos may have also involved minors. The crimes are believed to have occurred during the past three years.

One of the people Smith allegedly sexted with was an underage girl, who lives out of the country. They reportedly had a relationship for more than five-years that started when the girl was 12-years-old.

Smith has been charged with enticing a minor over the internet and sexual exploitation of a minor, both second-degree felonies. He also faces charges of voyeurism, three counts of distribution of pornography, dealing in materials harmful to a minor, and soliciting or distributing child pornography, all third-degree felonies.

Smith did not speak during Tuesday appearance. He is currently out of jail after posting $25,000 bail. He was ordered to appear again in court March 27.
