Garden City’s eminent domain meeting postponed

Garden City Mayor John Spuhler speaks with Utah legislators about Bear Lake beach access July 2015.

GARDEN CITY – A city meeting that was planned for Thursday, Jan. 12 has been postponed.

Garden City Mayor John Spuhler has been planning on using eminent domain to acquire two lanes that connect Garden City with a public beach. He was going to use the public meeting to present and explain his reasons for the decision, but told KVNU and in a voicemail that the meeting will be postponed because of ongoing talks with the Shore Lodge Estates HOA.

The lanes are two of six that have been the center of a legal battle since 2013. Residents of Shore Lodge Estates claimed the roads have always been private driveways, but others claimed they were public roads. After the matter went to court, First District Court Judge Thomas Willmore’s ruling declared the lanes private.
