Man accepts plea deal after arrest on lewdness

LOGAN — A 44-year-old Brigham City man, arrested last week for inappropriately touching himself in public, has accepted a plea deal and will now await sentencing.

David R. Zobell appeared in 1st District Court Monday afternoon. He pleaded no contest to one charge of lewdness by a sex offender, a third-degree felony, and guilty to driving under the influence of alcohol, a class B misdemeanor. As part of the agreement, prosecutors dropped three remaining misdemeanors.

State attorney Spencer Walsh told the court, Zobell was arrested last Tuesday night after a citizen witnessed him masturbating in public at First Dam, near the mouth of Logan Canyon. The citizen called 911 and said the defendant also was making inappropriate gestures toward them.

The no contest plea means Zobell admitted that prosecutors had sufficient evidence to charge him with lewdness, without acknowledging he was guilty.

Walsh told the court the charge of lewdness was enhanced because Zobell had three similar previous convictions, one involving a child.

Sentencing was scheduled for July 18.
