LOGAN — A 32-year-old North Logan man who was on probation after originally being charged with 10 counts of sexual exploitation of a minor, has been found in possession of child pornography again and will now await sentencing in October.
Brian Hurd appeared in 1st District Court Monday morning. He was arrested August 29 after probation officers said they found Hurd had again been downloading child pornography on the internet and was not attending therapy sessions.
On February 3, 2014, Hurd pleaded guilty to one count of sexual exploitation of a minor, a second-degree felony. Under conditions of his plea, prosecutors dropped nine remaining charges. He was sentenced to serve one-to-fifteen years in prison. The sentence was suspended under the agreement that he serve at least 180-days in jail and complete a sex offender program at the Northern Utah Community Correctional Center (NUCC). He was also placed on probation for three-years.
During court on Monday, Hurd admitted to possessing child pornography again and not attending therapy, both violations of his probation. He was ordered to remain in jail and appear again in court October 19, for sentencing.
