SALT LAKE CITY (AP) — A federal trial for the man charged with the 2002 kidnapping of Elizabeth Smart is nearing its end.U.S. District Judge Dale Kimball has ordered the trial of Brian David Mitchell be handed over to a jury for deliberations beginning Dec. 10.The 57-year-old Mitchell is charged with kidnapping and unlawful transportation of a minor across state lines for the purposes of illegal sex. If he is convicted, Mitchell could spend the rest of his life in prison.Mitchell’s defense attorneys don’t dispute that Smart was kidnapped in 2002 and held captive for nine months. But they’ve mounted an insanity defense, arguing that Mitchell is mentally ill and can’t be held responsible for the crimes.Prosecutors believe Mitchell is faking mental illness to avoid prosecution.
