Logan man accused of rape waives preliminary hearing and pleads not guilty

LOGAN — A 19-year-old Logan man has waived his right to a preliminary hearing and again denied raping a woman last spring. Devoney I. Stanley was arrested in October and booked into the Cache County Jail. He later posted $10,000 bail and was released.

Stanley appeared in 1st District Court Monday afternoon. He has been charged with one count of object rape, a first-degree felony.

According to a police report, the crime allegedly occurred on campus at Utah State University in May.

During Monday’s hearing, defense attorney David Perry told the court they wished to waive their right to a preliminary hearing, where a judge would have determined if prosecutors have sufficient evidence to bind Stanley over for trial. He also entered a plea of “not guilty” to the charge for his client.

Perry later asked for a pretrial conference in a month, to give them time to work out a possible plea agreement with prosecutors.

Judge Thomas Willmore set the hearing for February 3.

Stanley did not speak during Monday’s court appearance. As part of his pretrial release, he is prohibited from consuming any illegal drugs or alcohol, and stay away from the alleged victim’s residence and place of employment. He could face up to life in prison if convicted.
