Logan man suspected of unlawful sex with a minor temporarily released from jail

LOGAN — A 19-year-old Logan man has been temporarily released from jail while the felony sex case against him proceeds through court. Devin Montgomery was arrested January 24, and was being held in the Cache County Jail on $2,500 bail.

Montgomery appeared in 1st District Court Tuesday morning. He previously was charged with 12 counts of unlawful sexual activity with a minor, a third-degree felony.

Public defender Bryan Galloway told the court, he and prosecutors worked out an agreement for Montgomery be released on pre-trial supervision. Under the terms, the defendant is prohibited from having any contact with the victim or their family. He will also have to live with his father and meet with probation agents regularly.

Galloway said he and Montgomery are still deciding whether to have a preliminary hearing, where a judge would determine whether prosecutors have sufficient evidence to bind the defendant over for trial.

Judge Kevin Allen granted Montgomery’s release after reviewing the pre-trial conditions. He ordered the defendant to appear again in court March 5.
