LOGAN — More charges have been filed against Nicholas L. Smith. The 32-year-old Nibley man is already suspected of sexting a teenage girl and is now accused of filming himself having sex with people, and distributing the videos on the internet.
Smith appeared in 1st District Court Tuesday morning. State attorneys earlier had charged him with voyeurism and three counts of distribution of pornography, all third-degree felonies. He already faces charges of enticing a minor over the internet and sexual exploitation of a minor, both second-degree felonies, dealing in materials harmful to a minor and soliciting or distributing child pornography, both third-degree felonies.
Smith was originally arrested in December after a family member called deputies. They reported finding “disturbing text messages” on his phone.
Deputies believe Smith recorded himself having sex with people multiple times in Nibley and also Logan Canyon. The victims claim they consented to have sex but did not know they were being filmed. Some of the videos may have involved minors. The crimes are believed to have occurred during the past three years.
One of the people Smith allegedly sexted with was an underage girl, who lives out of the country. They reportedly had a relationship for more than five-years that started when the girl was 12-years-old.
Smith did not speak during Tuesday’s court appearance. His defense attorney asked to have both cases combined for an upcoming preliminary hearing. Judge Kevin Allen will determine at that time whether prosecutors have sufficient evidence to bind the defendant over for trial.
Smith, who is out of jail after posting $25,000 bail, was ordered to appear for the hearing February 20. He was also ordered to have no contact with the alleged victims.
