Logan man sentenced for intentionally shooting himself now accused of raping woman

LOGAN — A 33-year-old man who is serving up to five-years in prison for previously shooting himself in the arm, prompting a neighborhood lock-down, may now face more time. Jose L. Almaguer is accused of raping a woman in June 2015, before he was most recently incarcerated.

Almaguer was transferred from the Utah State Prison in Beaver, to appear in 1st District Court Monday morning. He has been charged with one count of rape, a first-degree felony. A four-day jury trial was scheduled to begin January 16.

Public defender Mike McGinnis asked the court to postpone the trial so that he can discuss a possible plea deal with Almaguer. He explained that there had been difficulties meeting since the defendant is being held in Beaver. He also said that they had been unable to locate a DNA expert, who would be called as an expert witness.

In August 2016, Almaguer was sentenced to prison after previously pleading guilty to possession of a firearm by a restricted person, a third-degree felony and 16 other misdemeanors.

The charges stemmed from an incident in October 2015, when Almaguer showed up at a woman’s home saying he shot himself. Police set set up a perimeter around the neighborhood and placed several nearby schools on lock-down. Officers later found him hiding behind a home near 1394 N. 290 W. He had what appeared to be a small caliber gunshot wound to his right wrist. He was hospitalized and later arrested.

During Monday’s court appearance, Judge Thomas Willmore delayed the trial and ordered Almaguer to appear again in court January 17.
