Jury trial set for daycare operators arrested on suspicion of child abuse

LOGAN — A jury trial has been scheduled for the operators of a North Logan day care center, charged with child abuse.

Craig and Brenda Petith were in 1st District Court Tuesday morning with defense attorney Bryan Sidwell. They asked the court to set the three-day trial.

Sidwell also told the court he filed a motion to dismiss the charges, based on prosecutor’s lack of providing evidence to the Petiths. He asked the court to schedule a hearing where he and state attorneys could argue the motion.

The Petiths were booked into the Cache County Jail in December. The 48-year-old man and 45-year-old woman were both later charged with misdemeanor child abuse. Both are out on bail.

Police began investigating the couple, after receiving a child abuse neglect report from the Division of Child and Family Services. The report alleged multiple incidents of child abuse at Brenda’s Day Care.

Investigators later uncovered evidence that supported the allegation.

The Petith’s day care is operated out of their home and is also being investigated by the Bureau of Child Development that issues day care licenses.

During Tuesday’s court appearance, Judge Brian Cannel scheduled the jury trial for March 7 through 9. He ordered them to appear again November 30 for the evidentiary hearing.
