Cody Smith appears in court on child-rape charges

LOGAN — A 39-year-old man facing charges including first-degree felony rape of a child, made his first appearance in 1st District Court Tuesday.

Cody C. Smith appeared before Judge Brian Cannell and was ordered to return to court for a preliminary hearing, April 2.

Smith was arrested Tuesday, March 11 and faces 10 charges including five counts of first-degree felony rape of a child, one count of first-degree felony object rape, one count of second-degree felony forcible sexual abuse and three counts of third-degree felony assault charges.

Smith is being held in maximum security at the Cache County Jail.

During Smith’s video arraignment from jail Thursday, March 13, state attorney Barbara Lachmar said there are four victims in this case and asked Judge Cannell to keep bail set at $100,000.

Judge Cannell said he agreed with the state and considers Smith a danger to the community. He set his bail at $80,000.
